North Cyprus planning approval vs subdivision and building permit

Short answer

As of 22 October 2026, North Cyprus treats these as separate stages: an imar planı sets what may be built where; Planlama Onayı from the Şehir Planlama Dairesi approves a specific development; a Cap. 96 permit from the competent authority allows subdivision or building; and the Land Registry registers the result. Land being "imara açık" does not mean any parcelling or building has been approved.

AI visual concept — illustrative, not a photograph of a specific place or property.

Are zoning, planning approval, subdivision permit and building permit the same thing?

No. They are separate layers, decided by different bodies under different laws, and each one is checked on its own:

  1. Plan coverage (imar planı): whether an İmar Planı, Çevre Planı, priority-area plan or decree (emirname) covers the land, and what it allows there.
  2. Planlama Onayı: approval of a specific development (building, change of use, parcelling, road, demolition) against that plan.
  3. Subdivision permit (parselasyon izni): the Cap. 96 permit to divide land into separate plots.
  4. Building permit (inşaat izni): the Cap. 96 permit to build.
  5. Completion and registration: the approval certificate for completed work, and registration at the Land Registry.

People sometimes say "planlama izni"; the legal term is Planlama Onayı. For the subdivision workflow itself, see land subdivision in North Cyprus.

What does an imar planı decide, and who approves it?

The planning authority is the Şehir Planlama Dairesi (Law 55/1989 art. 2), which prepares İmar Planları (art. 7(1)). A plan may set setbacks, plot coverage, minimum parcel size, height and floor count (art. 8(3)(A)), so these rules differ from plan to plan.

  • Approval: the national physical plan is approved by the Council of Ministers; other plans by the Birleşik Kurul (art. 2). Under art. 15(1) the Birleşik Kurul is made up of representatives of the municipality or municipalities and the district Kaymakamlık, and the planning authority is also represented.
  • Procedure: a public participation and objection period (42 days in the law as read, art. 14(3)), approval, then publication in the Official Gazette and at least two local dailies (art. 14(5)(B)); in force from publication unless stated (art. 14(5)(F)).
  • Decrees: where no plan exists but development is fast, a pre-plan boundary (Ön İmar Sınırı) may be drawn by decree (art. 11(4)), and the planning authority may grant planning approval for specified developments by a General or Special Development Order (art. 19).
  • Priority: where an İmar Planı exists, its rules apply regardless of other laws, including Cap. 96 and the Municipalities Law (art. 11(5)(A)).
  • Outside the boundaries: no development except agricultural divisions, unless a decree allows it (art. 11(5)(C)).

On 22 October 2026 the Town Planning Department listed, among plans in force, the Gazimağusa-Yeniboğaziçi-İskele plan, the Başkent Lefkoşa plan, the Girne-Çatalköy plan and others, and decrees for areas including Girne, Karpaz and Tatlısu-Büyükkonuk. Check the current list for your parcel; it changes.

Does "imara açık" land mean I can build or subdivide?

No. Plan coverage tells you what the plan allows in a zone; it is not an approval for your parcel. Three articles of Law 55/1989 set the relationship:

  • Art. 17(1): "Planlama Onayı alınmadan hiçbir taşınmaz mal geliştirilemez" (no immovable property may be developed without planning approval). Parcelling is development (art. 16(2)(E)).
  • Art. 39: no building permit is issued for any development that has not received planning approval under the law.
  • Art. 40: where there are no plans, or plan boundaries have not been drawn, planning approval does not apply.

So whether a parcel needs Planlama Onayı at all depends first on which plan, decree or conservation area covers it, and that is a parcel-by-parcel check. Even where planning approval is not required, Cap. 96 permits for subdivision and building (s. 3(1)) may still apply; confirm with the authority.

How does Planlama Onayı work?

  • Who grants it: the planning authority (art. 18). For developments affecting a wide area, the Lefkoşa, Gazimağusa and Girne municipalities, and other municipalities within one plan area, are consulted.
  • Appeal: against refusal or conditions, to the Minister or the city mayor (only one of them), within 28 days of the notice (art. 23).
  • Validity: the law as read says development must start within three years or a shorter period set by the authority, with an extension sought within one month if started but not finished (art. 24). Whether this has been amended was not confirmed.
  • Decision periods: the Planning Approval Regulation says applications classed "A" are decided within 40 working days and "B" within 65, extendable up to 130 where an additional assessment report is needed (Regulation art. 22, 33). These are legal maximums, not observed times, and we give no timeline.
  • Parcelling files: the Regulation (art. 4(g)) requires the current-year practice certificate of the Architects' or Civil Engineers' Chamber for parcelling projects.

What are the subdivision permit and the building permit?

Cap. 96 (Fasıl 96) s. 3(1) says nobody may build, or divide land into separate plots, without a prior permit from the competent authority. Within municipal limits that authority is the municipal council (s. 3(2)(a)); outside them it was not confirmed from a primary source. The Municipalities Law 51/1995 gives municipalities the duties set by the planning law and Cap. 96 (s. 17(1)), requires the municipality's prior written permission to divide land into more than two building plots (s. 97(2)), and lets it charge building-permit and parcelling fees (s. 97). Fee amounts were not confirmed.

  • Permit validity: one year from issue in the Cap. 96 text as read (s. 5); whether still current was not confirmed.
  • Conditions: a parcelling permit may require roads, water supply, electricity, parking and a green area capped at 10% of the area divided (s. 9(1)(c)).
  • Completion: an approval certificate is issued once the authority is satisfied the permitted work is complete (s. 10(2)); nobody may occupy a building before it (s. 10(1)).
  • Registration: the District Land Registry does not register permit-requiring work without that certificate unless the Director waives it (s. 16).

How do I read "imarlı", "parsellenebilir" or "müstakil tapulu" in a listing?

These are sales words, not legal categories. Ask what dated document stands behind each one:

Listing claimWhat it may meanDocument to ask for
"İmarlı" / "imara açık"The land lies in a zone of a plan that allows buildingThe planning office's zoning-status document for that parcel, with its date, and the plan's Official Gazette reference
"Parsellenebilir"Someone believes the land could be dividedPlanlama Onayı and the Cap. 96 subdivision permit, with dates and conditions; without them it is an opinion
"Müstakil tapulu"The plot has its own registered parcelA current Land Registry search for that parcel number
"İnşaat izinli" / "projeli"A building permit or approved project existsPlanlama Onayı (where a plan applies) and the Cap. 96 building permit, with dates; check the stated validity

Under Law 38/2007 s. 16 the seller must give the buyer, through the estate agent, the Land Registry search certificate and the planning office's zoning-status document. Have an independent lawyer read them. See title encumbrances and legal verification and the buyer checklist.

Can the rules change after I buy? A 2026 example

Yes, plans are amended. Official Gazette No. 175 (Special Issue II), 14 September 2026, Annex III, A.E. 831 published the 2026 amendment to the Gazimağusa-İskele-Yeniboğaziçi plan, approved on 22 May 2026 under art. 14 and 15 and in force from publication. Its art. 7 restates the rule for that plan area: no permit may be given under other laws for development without planning approval under the plan as amended. Its scope includes extending development boundaries; among the plan-report sections it amends is 4.8.12 on parcelling, which the subdivision guide describes. These rules apply only inside that plan area and do not show that any parcel benefits.

How NORTHEA helps

NORTHEA coordinates the checks and assembles the documents for each layer into one dossier; the authorities decide, and lawyers, licensed surveyors, architects, planners and engineers deliver the reserved professional work. NORTHEA does not issue legal opinions; we coordinate independent legal review and assemble due diligence dossiers.

For land questions see agricultural land and fields and the land and subdivision advisory service. Send parcel details through the private enquiry page, not publicly.

Exceptions and limits. This page states no fees and no observed processing times; the decision periods it mentions are legal maximums printed in the Planning Approval Regulation, not what happens in practice. The planning law copy we read is the 1989 text and the Cap. 96 copy is consolidated only to 1992, so later amendments, including whether the validity periods quoted are still current, were not confirmed. Who grants Cap. 96 permits outside municipal limits was not confirmed. Table cells without a source say "confirm with the authority".

Questions buyers ask

Is planning approval the same as a building permit in North Cyprus?

No. Planlama Onayı is granted by the Şehir Planlama Dairesi under Law 55/1989; the building permit is a Cap. 96 permit from the competent authority, the municipal council within municipal limits. Art. 39 says no building permit is issued without planning approval where it applies.

If land is "imara açık", can I build on it?

Not on that basis alone. Plan coverage says what a zone allows; a specific development still needs Planlama Onayı where a plan applies (art. 17) and a Cap. 96 building permit.

Does every parcel need Planlama Onayı?

No. Art. 40 says planning approval does not apply where there are no plans or plan boundaries. Which layer applies is checked parcel by parcel; Cap. 96 permits may still apply; confirm with the authority.

Who approves an imar planı?

Plans are prepared by the Şehir Planlama Dairesi and, except the national physical plan, approved by the Birleşik Kurul (art. 2, 15), then published in the Official Gazette (art. 14(5)).

What document proves a listing is "imarlı"?

Ask for the planning office's document showing the parcel's zoning status, which the seller must provide through the estate agent under Law 38/2007 s. 16, with its date, and have a lawyer check it.

What does "parsellenebilir" mean in an advert?

It is an opinion unless backed by Planlama Onayı and a Cap. 96 subdivision permit for that parcel, with dates and conditions.

Can I appeal a refused Planlama Onayı?

Under Law 55/1989 art. 23, an appeal against refusal or conditions goes to the Minister or the city mayor, only one of them, within 28 days of the notice. Take legal advice before relying on it.
