Agricultural land (tarla) in North Cyprus: what to check
As of 22 October 2026, a field (tarla) in North Cyprus outside a plan's development boundary falls under Planning Law art. 11(5)(C), which allows only agricultural divisions unless a decree says otherwise. Agricultural and forest land may not be sold to foreigners (Law 52/2008, s. 4(1)). Building on or dividing it needs planning approval where a plan applies, and a subdivision permit. Check planning status with a dated document.

What counts as a field (tarla) rather than building land?
In everyday use, a tarla is an agricultural parcel and an arsa is a building plot. What decides how a parcel may be used is not the word in the advert but where the parcel sits in the planning system. The Planning Law (İmar Yasası 55/1989) defines agriculture broadly: horticulture, fruit, vegetables, grain, dairy, livestock and pasture (art. 2).
| Where the parcel is | What the law says | Source |
|---|---|---|
| Inside the development boundary of an İmar Planı | The plan's rules apply, whatever another law says; the plan sets zones, setbacks, coverage, height and the minimum parcel size | 55/1989 art. 8(3)(A), 11(5)(A) |
| Outside plan or pre-plan (Ön İmar) boundaries | No development except agricultural divisions, unless a decree (emirname) allows it | 55/1989 art. 11(5)(C) |
| Where no plan or boundary has been drawn | Planning approval does not apply; Cap. 96 permits may still apply; confirm with the authority | 55/1989 art. 40 |
| Inside a pre-plan (Ön İmar) boundary | Only the developments the emirname lists (art. 11(5)(B)); a Koruma Alanı may be declared by emirname (art. 25(1)) | 55/1989 art. 11(5)(B), 25(1) |
The Town Planning Department (Şehir Planlama Dairesi) lists the plans in force, including Gazimağusa–Yeniboğaziçi–İskele, Başkent Lefkoşa, Girne–Çatalköy, Alagadi ÖÇKB, Beyarmudu and Mehmetçik, and decrees for areas such as Girne, Karpaz and Tatlısu–Büyükkonuk. Which layer covers a given field is a parcel-by-parcel check. The three permit layers are explained in planning approval, subdivision and building permits.
Can foreigners buy agricultural land in North Cyprus?
No. Law 52/2008 s. 4(1) states that immovable property in agricultural and forest land may not be sold to foreign natural or legal persons. Restricted zones for foreigners may also be set by regulation, and registrations made against such a regulation are void (s. 4(2)).
Foreign individuals and foreign companies may buy property in the TRNC only with purchase permission from the Council of Ministers, within the limits of Decree-Law 119/2026. A company with any foreign shareholding counts as a foreign legal entity. The limits, deadlines and the dated change log are on foreign-buyer rules. Ask your lawyer for written confirmation of each parcel's class before any deposit.
Can you build on a field or divide it into plots?
Only through the permit layers, and each stage is conditional on the authority's decision:
- Planlama Onayı (planning approval). "Development" includes building, change of use, road building and every kind of parcelling and division (55/1989 art. 16(2)(E)); no immovable property may be developed without planning approval (art. 17(1)). The Town Planning Department grants it (art. 18). People often call it "planlama izni"; the legal term is Planlama Onayı.
- Subdivision (parcelling) permit. Nobody may divide land into separate plots without a prior permit under Cap. 96 s. 3(1)(c). Within municipal limits the competent authority is the municipal council (s. 3(2)(a)); the Municipalities Law also requires the municipality's prior written permission to divide land into more than two plots for building (51/1995 s. 97(2)).
- Building permit (inşaat izni). No building permit is issued for a development without planning approval (55/1989 art. 39).
- Registration. The Land Registry and Cadastre Department applies approved parcelling on the ground (Law 45/2025 s. 4(26)).
Outside plan boundaries, the law itself names agricultural divisions as the exception (art. 11(5)(C)). Whether a particular division counts as agricultural, and which authority issues the subdivision permit outside municipal limits, are questions for the authority and your lawyer. The process in detail: land subdivision and parcelling.
Which protected areas and environmental rules can affect a field?
- Special Environmental Protection Areas (Özel Çevre Koruma Bölgeleri, ÖÇKB). Declared by the Council of Ministers on the ministry's proposal (Environment Law 18/2012, s. 42(1)). A plan or project that may significantly affect such an area needs an ecological impact assessment and may be permitted only with a positive opinion from the Environmental Protection Department (s. 42(3)). The Alagadi ÖÇKB environmental plan is listed among plans in force.
- Coast. The environmental quality of all coastlines is protected (s. 23), and a new septic tank or soakaway within 500 metres of an aquifer, stream or coastline needs the Environmental Protection Department's permission (s. 18(6)). This page states no coastal building setback: no primary text of a coastal protection law was found. The Town Planning Department publishes coastline maps.
- Conservation areas. The planning authority may declare a Koruma Alanı by decree (55/1989 art. 25(1)).
- Restricted areas. Ask whether any military or other restricted area affects the parcel; this page does not describe those rules.
Do agricultural-area rules change? A dated example from 2026
Yes, plans are amended. The 2026 amendment to the Gazimağusa–İskele–Yeniboğaziçi plan was approved on 22 May 2026 and published in Official Gazette No. 175 (Special Issue II), 14 September 2026, Annex III, A.E. 831; it entered into force on publication. It is read together with the base plan published in Official Gazette No. 230, 1 November 2023, Annex III, A.E. 878.
- Its stated scope includes extending development boundaries and rules for developments in the Agricultural Development Area between the plan and development boundaries.
- Under the amended plan report, areas outside the development boundaries are an Agricultural Development Area whether or not they are fit for farming. Permitted developments there are mainly farm buildings, greenhouses, farm stores, agricultural divisions and farm roads, with limited exceptions decided at planning-approval stage.
- No permit may be given under other laws for development that lacks planning approval under the amended plan (Gazette No. 175, art. 7).
- The amendment documents are open for inspection at the Gazimağusa, Yeniboğaziçi and İskele municipalities, the Gazimağusa and İskele district offices (Kaymakamlık) and the Town Planning Department.
Applies only inside that plan area. On 22 October 2026 the Town Planning Department website still listed this amendment as work in progress; the Official Gazette prevails. An amendment does not mean that any particular parcel benefits: check the plan maps for the parcel itself.
What should you check before buying a field?
Ask your lawyer, surveyor and planner, in writing, and keep the date of every document:
- Title type and owners. Who owns the parcel, in what shares, and what type of title it is (title deeds).
- Encumbrances. Any mortgage, charge, court order or other entry on the Land Registry search (title and legal verification).
- Planning status, dated. The seller must give the buyer, through the estate agent, the Land Registry search certificate and the planning office document showing the property's zoning status (imar durumu) (Law 38/2007 s. 16). Note the date on it: plans change.
- Access. Is there a legal, registered road to the parcel, or only a track used by custom?
- Water and services. Where water, electricity and drainage would come from, and any permission a septic tank or soakaway would need.
- Conservation and environmental limits. ÖÇKB, conservation area, coast, or a restricted area.
- Class for foreign buyers. Written confirmation of whether the parcel is agricultural or forest land under Law 52/2008.
The full purchase checklist is in property due diligence and the buyer checklist.
What are the main risks with agricultural land?
- Use risk: a field outside development boundaries may never be approved for building; no plan change is assured.
- Eligibility risk: a foreign buyer cannot buy agricultural or forest land, and a registration against a restricted-zone regulation is void.
- Division risk: parcelling needs planning approval and a subdivision permit, and the permit may carry conditions such as roads, water and electricity (Cap. 96 s. 9(1)(c)).
- Access and services risk: without a registered road or services, cost and use are uncertain.
- Out-of-date information: a zoning letter or plan map that predates an amendment may no longer describe the parcel.
How NORTHEA helps with a field purchase
NORTHEA coordinates the checks: we collect the dated planning-status document, the title search and the plan references for the parcel, flag what is confirmed and what is still open, and work with your independent lawyer, a licensed surveyor (harita mühendisi) and a registered planner. Lawyers, surveyors, planners and engineers deliver their own professional services, and public authorities decide every approval. NORTHEA does not issue legal opinions; we coordinate independent legal review and assemble due diligence dossiers.
To start, see land and subdivision advisory and send the parcel reference through the private enquiry channel; never post title documents publicly.
Legal review: checked by a lawyer registered with the KKTC Bar. The legal points on this page are read from the laws and Official Gazette issues listed under sources, as of 22 October 2026, and have been checked by a lawyer registered with the KKTC Bar.
Exceptions and limits. This page states no coastal building setback, because no primary text of a coastal protection law was found; no minimum parcel size, because it is set plan by plan; and no fee or processing time. Who grants a subdivision permit outside municipal limits, how a split into only two plots is treated, the Fasıl 224 division (ifraz) procedure, and whether roads and services must be finished before separate titles are issued were not confirmed from a primary source: ask your lawyer and the authority. Military restricted zones are raised only as a question.

Questions buyers ask
Can a foreigner buy a field (tarla) in North Cyprus?
No. Law 52/2008 s. 4(1) bars the sale of agricultural and forest land to foreign individuals and legal entities. A company with any foreign shareholding counts as a foreign legal entity. Ask your lawyer to confirm each parcel's class in writing.
Can I build a house on agricultural land in North Cyprus?
Only if the planning rules for that parcel allow it and planning approval and a building permit are granted. Outside plan boundaries the Planning Law allows no development except agricultural divisions unless a decree allows it (art. 11(5)(C)). The authority decides.
Can a field be divided into building plots?
Only with planning approval where a plan applies and a subdivision permit under Cap. 96 s. 3(1)(c), plus the municipality's written permission for more than two building plots within its area. The applicable plan sets the minimum parcel size.
How do I find out a field's planning status?
Ask for the planning office's zoning status (imar durumu) document; under Law 38/2007 s. 16 the seller must provide it through the estate agent, with the Land Registry search certificate. Check its date and the current plan.
What changed in the 2026 Gazimağusa–İskele–Yeniboğaziçi plan amendment?
In force from 14 September 2026 (Official Gazette No. 175), it covers extending development boundaries and rules for the Agricultural Development Area, among other points, and amends plan-report section 4.8.12 on parcelling. It applies only inside that plan area and does not mean any parcel benefits.
Is there a coastal setback for fields by the sea?
This page states none, because no primary text of a coastal protection law was found. The Environment Law protects coastlines and requires permission for a new septic tank within 500 metres of the coast. Ask your lawyer and the planning office in writing.
Does NORTHEA give legal opinions on land?
No. NORTHEA does not issue legal opinions; we coordinate independent legal review and assemble due diligence dossiers. Your own TRNC lawyer gives the legal advice.
