Buying property in North Cyprus from Germany, Austria or Switzerland
Buyers from Germany, Austria and Switzerland buy in North Cyprus (TRNC) under the same rules as other foreigners: purchase permission from the Council of Ministers, within the limits of Decree-Law 119/2026. Whether a higher limit applies to your nationality is a question for your lawyer. Contract registration and the permission application can be made through a lawyer or an authorised attorney, so much of the work can run from home.

1. The rules that apply to you
Foreign individuals and foreign companies may buy property in the TRNC only with purchase permission from the Council of Ministers, within the limits of Decree-Law 119/2026 (TRNC Official Gazette No. 196, 6 October 2026, art. 4, as substituted in s. 8(1) of Law 52/2008). The limits are alternatives, one of these forms: a plot of up to 1,338 m² on which only one dwelling may be built; up to 3 apartments; a detached house on land of up to 3,300 m², with no second dwelling on that land; or 2 two-storey detached villas within a housing estate or site.
A company in which a foreigner holds a share or capital of any size or kind, or whose directors are mostly foreign, counts as a foreign legal entity (art. 3(2)). Buying through a company, whether registered at home or in the TRNC, therefore does not by itself take you outside the permission rules; ask your lawyer how any structure you are considering is treated. The full rules, with the project caps and the dated change log, are on our foreign-buyer rules page and in our guide Can foreigners buy property in North Cyprus?.
Decree-Law 119/2026 repealed Decree-Law 89/2026 (art. 14) and took effect on publication (art. 16). Ask your lawyer to confirm the text in force on the day you sign, and again before transfer.
2. The question of the higher limits
The decree allows 6 apartments instead of 3, or 3 two-storey detached villas on an estate or site instead of 2, only for nationals of states that recognise the TRNC and give TRNC citizens the same right (s. 8(1)(B) and (Ç)). Northea does not list which states meet that test, and this page makes no statement about Germany, Austria or Switzerland. Ask your lawyer, in writing and before you reserve:
- Does a higher limit apply to my passport?
- If I hold more than one nationality, which one will the application rely on?
Northea analysis: plan your purchase on the standard limits until you have that answer in writing.
3. Before you start: title history and permission
Two background points deserve a careful reading before you commit. Both are covered on existing Northea pages.
- Title history. Our German guide sets out the background on property of pre-1974 Greek Cypriot origin and cites the 2009 judgment of the Court of Justice of the EU in Apostolides v Orams (Case C-420/07) (Immobilien in Nordzypern kaufen). Our UK guide quotes the UK government's guidance on the same subject. If you live in the EU, ask your lawyer in writing what that judgment could mean for you and for the specific parcel.
- Permission is a decision. The UK government's guidance warns that permission to purchase may be refused and that no reason may be given (GOV.UK, "Cyprus: buying property", last updated 27 November 2019, as quoted in our eligibility guide).
What a given parcel's history means is a legal question. Ask your lawyer for a written opinion on the title type and the chain of title before you pay anything beyond a reservation deposit, and ask, before you pay that deposit, whether and on what terms it is refundable. Title types are explained here, and the 15 questions to ask before paying a deposit are in our due-diligence guide.
Northea has not read the German, Austrian or Swiss foreign ministries' current guidance for this page. Read your own government's travel and property advice before you travel and before you sign.
4. Documents from Germany, Austria or Switzerland
Our eligibility guide summarises the Ministry of Interior's published document list for a permission application. Requirements can change, and some documents come from registers at home. Before you order anything, ask your lawyer:
- Which documents does the Ministry require from me today, and in which form?
- Is a criminal record certificate required from me, and if so, which one is accepted: the German Führungszeugnis, the Austrian Strafregisterbescheinigung or the Swiss Strafregisterauszug?
- Must each document carry an apostille or other legalisation, and from which authority?
- Must it be translated into Turkish, and by whom: a sworn translator in my country, or in the TRNC?
- How recent must it be on the day the application is filed?
The same questions apply to a power of attorney (Vollmacht) signed at home: whether it must be signed before a notary, whether it needs an apostille, in which language it must be drafted, and exactly which acts it authorises. Ask your lawyer to draft it narrowly.
5. Buying at a distance: the order of work
Under Decree-Law 119/2026, the stamped contract is registered, and the permission application made, in person, through a lawyer or through an authorised attorney (s. 8(6)(1)). Distance changes how documents move, not the steps.
- Appoint an independent TRNC-licensed lawyer who does not act for the seller or developer.
- Prepare your documents and the power of attorney as your lawyer specifies.
- Have the title searched and its history set out in writing before you pay anything beyond a reservation deposit, on refund terms you have read.
- Sign the contract in a language you understand. The decree requires the stamped contract to be registered at the District Land Registry within one month, with all taxes and fees due on the sale paid, and the permission application to be made; otherwise the contract is void (s. 8(6)(1)). Ask your lawyer from which date the month runs in your case, and how much money must be ready at signature.
- Diary the deadlines that follow publication of your permission in the Official Gazette. Section 8(6)(2) sets one year from publication for the transfer at the Land Registry. Section 8(7) says that where no mortgage is set up in the seller's favour, the one-year period runs from the date the full price is paid, and that the title transfer fees must be paid within 75 working days of publication, or the permission lapses. Ask your lawyer, in writing, from which date your one-year period runs.
- Work through our buyer checklist. The International Buyer Desk runs an indicative eligibility pre-check and cost estimate; your lawyer confirms the result.
6. Paying from euro or Swiss francs
If the price in your contract is fixed in a currency other than the one you hold or earn, every movement in the exchange rate between reservation and the last payment changes what each payment costs you. Northea gives no exchange-rate forecasts and does not recommend providers. Ask yourself, your bank and your lawyer:
- In which currency is the contract price fixed, and in which currency are the staged payments due?
- Can the price be fixed in euro or francs, and at what cost?
- Which bank or regulated payment provider will you use, and what source-of-funds evidence will it ask for on a transfer to northern Cyprus?
Pay only into the account named in the contract, and confirm the account details with your lawyer by a separate channel before each transfer. Keep a complete file of contracts, invoices, transfer confirmations and receipts; your lawyer confirms whether the permission file, the Land Registry or a residence application needs bank evidence of payment. The full payment map is in Banking and transferring funds for a North Cyprus property purchase.
7. Tax at home: the questions for your adviser
Northea gives no German, Austrian or Swiss tax advice. If you are resident in one of these countries, your home tax rules may apply to rental income from, or a gain on, property abroad, and possibly to a gift or an inheritance of it. Before you buy, ask your Steuerberater (in Switzerland, your tax adviser or Treuhänder):
- Must I declare rental income from northern Cyprus, and how is any TRNC tax treated?
- Does any double-taxation agreement apply to income from the north of Cyprus? Ask for the answer in writing.
- How would a later sale be taxed where I live, and does the holding period matter?
- If I hold through a company, what are the consequences at home?
- How would the property pass on death, and which law governs that?
TRNC purchase and ownership costs are in our taxes and costs guide; this page adds no rate.
8. Residence, and what it is not
Our buying guide explains that a home in the TRNC that is suitable for living in and used as your residence can be the basis of an application for a short-term residence permit. Since October 2026: with a title deed in your name, 10 years at a total value of GBP 300,000 or more and 5 years below that, with no income condition (TRNC Official Gazette No. 193, 2 October 2026, A.E. 932); with a stamped and certified sales contract, 5 years with no income condition at GBP 300,000 or more, and below that 5 years, or up to 5 years, on proof of one minimum wage of regular monthly income (Official Gazette No. 194, 5 October 2026, A.E. 943). The text sets the threshold in sterling "or the equivalent in another currency" and does not say which exchange rate or date applies to a euro or franc price; ask your lawyer how the value will be assessed.
This is a residence permit under TRNC law, not citizenship. Ask an immigration specialist how a TRNC permit is treated in the Republic of Cyprus and in the Schengen area before you rely on it for travel.
9. Language and who you will deal with
Northea's named advisor, Al Bazarov, advises in Turkish and English. Ask in which language each document you sign is drawn up, ask for a translation into a language you read, and keep both versions. Northea coordinates; your independent lawyer advises and is responsible for the legal work.
What this page does not do
Northea is not a law firm, tax adviser or immigration adviser. This page sets out the questions a buyer in Germany, Austria or Switzerland should settle. It gives no tax, fee or exchange rate, and it is not legal or tax advice. Rules change. Confirm every point with your own TRNC lawyer and your adviser at home before you commit.
Legal review: checked by a lawyer registered with the KKTC Bar. The legal points above are taken from the TRNC Official Gazette. This page has been checked by a lawyer registered with the KKTC Bar.
Exceptions and limits. Whether a higher purchase limit applies to your nationality is a question for your lawyer. Home-country tax questions belong with your own adviser, and residence is not citizenship.

Questions buyers ask
Can Germans, Austrians and Swiss buy property in North Cyprus?
Yes, under the same rules as other foreign buyers: purchase permission from the Council of Ministers, within the limits of Decree-Law 119/2026 (for example up to 3 apartments, or one of the other forms in the decree). Permission is a decision, not a formality. Your lawyer confirms the rules in force on the day you sign.
Do German, Austrian or Swiss nationals get the higher purchase limit?
Ask your lawyer. The decree reserves 6 apartments or 3 villas for nationals of states that recognise the TRNC and give TRNC citizens the same right. Northea does not list which states qualify. Plan on the standard limits until your lawyer confirms in writing which limit applies to your passport.
Can I buy from Germany without travelling to North Cyprus?
Much of the work can be done at a distance: contract registration and the permission application can be made in person, through a lawyer or through an authorised attorney (Decree-Law 119/2026). Your lawyer confirms the form a power of attorney signed at home must take, including any notarisation, apostille or translation.
Which documents do I need from home?
Ask your lawyer before you order anything. Our eligibility guide summarises the Ministry of Interior's published document list. Your lawyer confirms which documents are required today, whether a certificate from a German, Austrian or Swiss register is needed, whether it needs an apostille and translation, and how recent it must be.
Will I pay tax at home on rent or a sale?
Possibly. Northea gives no German, Austrian or Swiss tax advice. Ask your tax adviser in writing whether rental income or a gain must be declared at home, how TRNC tax is treated, and whether any double-taxation agreement applies to the north of Cyprus.
Does a TRNC residence permit let me live in the EU?
Northea does not advise on that. A TRNC residence permit is issued under TRNC law and is not citizenship. Ask an immigration specialist how it is treated in the Republic of Cyprus and the Schengen area before you rely on it.
