Penthouse for sale in North Cyprus: what to check before you buy
As of 15 October 2026: a penthouse for sale in North Cyprus is a top-floor residence in an apartment building, so the caps on foreign sales in the project are a first question. What sets it apart is what sits above the flat: roof and terrace rights, any terrace pool, and the permits for each. Ask your own TRNC lawyer to confirm these in writing before you reserve.

What a penthouse is, and how the rules treat it
A penthouse is a top-floor residence in an apartment building, usually with large terraces. The rules quoted on this site do not define the word: Decree-Law 119/2026 speaks of apartments and apartment parcels, so the apartment questions apply to the top floor.
A foreign buyer needs Council of Ministers permission and may buy up to 3 apartments, or 6 for nationals of states that recognise the TRNC and give TRNC citizens the same right. In one apartment parcel, related foreign buyers, or foreign buyers of the same nationality, may not buy more than half of the units, and at most 80% of a housing project in a zoned area may be sold to foreigners. On a sought-after top floor, our luxury property guide advises asking the developer for a written statement of foreign sales in the parcel and the project. Ask your lawyer how a penthouse counts towards your own limit; the full rules are in Can foreigners buy property in North Cyprus?
Where a penthouse for sale in North Cyprus is found
Top floors follow the apartment blocks. Kyrenia (Girne) has the densest concentration of apartments and services in the TRNC, so a penthouse in Kyrenia (Girne), Northern Cyprus, is a town-life purchase. West of town, Alsancak is a resort strip with dense apartment development and Lapta has newer complexes by a seafront walkway. On the east coast, İskele (Long Beach) is dominated by high-rise complexes, mostly sold off-plan.
NORTHEA's price per m² index reports apartments and villas from asking prices; it has no penthouse line, so a penthouse price has no benchmark there. Ask for dated comparables from the same building.
What sits above the flat: roof, terrace and pool
The extra value is outdoors, and so is the paperwork. NORTHEA's sky villa and duplex penthouse dossiers on the Private Properties page are illustrative examples, not offers, and show what we examine:
- Roof rights and exclusive use of any roof garden, confirmed in the building's constitution rather than a brochure.
- Structural certification for any pool built on a terrace.
- A building permit for every terrace, pool and extra floor and, once finished, an approval certificate. Under the Streets and Buildings Regulation Law (Cap. 96), nobody may occupy a building before the approval certificate is issued.
- The service charge: what it covers and who manages the building after delivery.
Ask an independent engineer to compare the permit drawings with the terrace as built. NORTHEA coordinates an engineer on request; it does not certify buildings.
Off-plan or complete: title and payments
A penthouse in a new block is often bought before completion. The buyer then holds a registered contract, not a title deed, until transfer, and individual titles follow the building's final approval. Ask how long the developer's earlier projects took to reach title. Tie payments to construction milestones, not dates, and fix one currency for every payment: see developer checks, off-plan payment plans and currency.
How a penthouse purchase runs with NORTHEA
NORTHEA represents the buyer, not the developer. We assemble the dossier (title, permit, building constitution, service-charge terms, foreign-sales position) and mark what is confirmed and what is open. Your independent TRNC-licensed lawyer, who acts only for you, runs the Land Registry search, reviews the contract and files the stamped contract and the permission application within one month. See due diligence, title deed types and taxes and costs.
Legal review: checked by a lawyer registered with the KKTC Bar. The legal points on this page are read from the TRNC Official Gazette and NORTHEA's own guides, and have been checked by a lawyer registered with the KKTC Bar.
Exceptions and limits. Penthouse is not a legal category in the rules quoted here, so how it counts towards the purchase limits is for your lawyer. NORTHEA gives no penthouse prices; the dossiers cited are illustrative.

Questions buyers ask
Can foreigners buy a penthouse for sale in North Cyprus?
Yes, with Council of Ministers permission and within the limits of Decree-Law 119/2026. Ask your lawyer how a penthouse counts towards your limit, and the developer for the building's foreign-sales position in writing.
Is a penthouse in Kyrenia (Girne), Northern Cyprus, different from a standard apartment?
The process is the same. The difference is outdoors: roof rights, terraces and any terrace pool each need their own papers.
Who owns the roof terrace of a penthouse?
Do not assume. Ask your lawyer to read the building's constitution and confirm in writing what you would own and what you would only use.
How are penthouse prices benchmarked in North Cyprus?
They are not. Our price index covers apartments and villas from asking prices, and there is no public transaction index.
Do I get a title deed when I buy a penthouse off-plan?
Not at signing. You hold a registered contract until transfer, and individual titles follow the building's final approval.
Does buying a penthouse give me residence?
No. Ownership is not residence. The Immigration Department decides each application, and NORTHEA does not arrange or promise residence.
