What is independent buyer representation in Northern Cyprus?

Short answer

As of 11 October 2026, independent buyer representation means the person advising you works for you, not the seller or developer, and tells you in writing who pays them. Your lawyer should be TRNC-licensed and not act for the seller or developer. Your property advisor should disclose whether they act for any seller and how their fee is paid.

The full answer

Independent buyer representation means the person advising you on a purchase works for you, not for the seller or the developer, and tells you in writing who pays them. In Northern Cyprus two roles matter most. Your lawyer should be TRNC-licensed and should not act for the seller or the developer. Your property advisor should tell you whether they act for the seller of any property they show you, and how their fee is paid. NORTHEA sets out its fees, and whether the buyer, the seller or both pay them, in writing in the engagement letter before any service is rendered.

Why representation matters in Northern Cyprus

Much of the property a foreign buyer sees is presented by people paid by the other side: a developer's sales office, an agent holding the seller's listing, or a portal that earns from advertisers (Northea analysis). None of that is improper. But it means the person showing you a property is often paid to sell that property, not to find you the right one. If you are still weighing a portal against a representative, read property portals vs buyer representation.

The legal side carries a sharper version of the same risk. UK government guidance on buying property in Cyprus, cited in our due diligence guide, lists lawyers acting for both vendors or builders among the problems buyers meet (GOV.UK, last updated 27 November 2019). A lawyer who also acts for the developer cannot press your interests against the developer's.

The deadlines after you sign leave little room to fix a mistake. Official rule: a foreign buyer's stamped contract must be registered at the District Land Registry within one month, with the taxes and fees due on the sale paid and the purchase-permission application filed, or the contract is void (s. 8(6)(1)). The title transfer fees must be paid within 75 working days of the purchase permission being published in the Official Gazette, or the permission lapses (s. 8(7)). The law also sets a one-year period for completing the transfer of title (s. 8(6)(2) and 8(7)). All three are in Decree-Law 119/2026, art. 4, applying s. 8 of Law 52/2008 (TRNC Official Gazette No. 196, 6 October 2026). Ask your lawyer, in writing, from which date the one-month period and the one-year period run on your purchase. Someone has to be watching those dates on your behalf. Dated changes to the rules are logged on our foreign-buyer rules page.

The roles on a purchase, and who each one works for

The lawyer and the advisor are different jobs. A buyer's advisor is not a substitute for a lawyer and should never give a legal opinion. A lawyer is not a property finder and usually does not negotiate the commercial terms. The contract registration and the application for purchase permission may be made by you in person, through your lawyer or through an authorised attorney (s. 8(6)(1)). If you give anyone a power of attorney, limit it in writing to the tasks you intend.

The Cyprus Turkish Bar Association publishes lawyer lists for the Lefkoşa, Girne, Mağusa and Güzelyurt bars, as noted in our due diligence guide.

Five tests of independence

Apply these to any advisor or agent, and get the answers in writing:

  1. Who pays you on this transaction? The buyer, the seller, the developer, or more than one of them? A fee from the seller is not disqualifying, but you must know.
  2. Do you act for the seller of any property you are showing me? If so, the advisor is acting for both sides on that property and should say how that conflict is handled.
  3. Do you receive commission or introduction fees from developers, lawyers, banks or other specialists you recommend? Referral payments affect advice even when they are small.
  4. Will you show me property you are not paid to sell? An advisor working for you should search the whole market that fits your brief, including property listed by others.
  5. What exactly is in scope, and what is not? A written engagement sets out the services, the fee, any exclusivity, the duration and how either side can end it.

What a buyer's advisor does, and does not do

Does: turns your requirements into a brief; searches the open market, active developments and private sellers; screens out unsuitable property before you travel; prepares dossiers with document statuses; arranges private viewings; negotiates within the mandate you set; coordinates your lawyer, engineer, accountant and bank; keeps track of the post-signing deadlines with your lawyer; and supports completion and handover.

Does not: give legal, tax, financial, investment or immigration advice; hold client money or act as escrow; guarantee title, permissions, timing, prices, rental income or appreciation. In NORTHEA's case these exclusions are written into the terms of service, and the independent professionals remain responsible for their own advice.

Questions to ask any advisor, including us

  • Can I see your engagement letter before I share my brief?
  • Who pays your fee if I buy, and when is it due?
  • Do you act for the seller of any property on my shortlist?
  • Do you receive any payment from the lawyer, bank or developer you are introducing?
  • Can you give me the names of more than one independent lawyer?
  • What is your estate agency licence number?
  • Who will be my single point of contact, and in which languages?
  • How will you send me documents, and how will you keep my information confidential?

An advisor who will not answer these questions in writing has already answered them.

How NORTHEA handles representation

  • One named advisor. Each qualified client has one named advisor who coordinates the whole journey (see Private Office). Our named advisor, Al Bazarov, works in Turkish and English.
  • Independent lawyers, introduced, not replaced. NORTHEA is not a law firm. Title, encumbrances, permits and the contract are checked by your independent TRNC-licensed lawyer. As our Private Office page puts it: "Northea coordinates; the lawyer advises."
  • Fees in writing first. NORTHEA's fees, and whether they are payable by the buyer, the seller or both, are set out in writing in the engagement letter before any service is rendered (see pre-contractual information).
  • Both sides of the market. NORTHEA also takes private seller mandates (see Sell Privately). If we show you a property, ask us whether we act for its seller; the answer and the fee arrangement are set out in writing in the engagement letter.
  • No money held. NORTHEA does not hold client money or act as escrow. Payments go to the parties and offices entitled to them.
  • Licence details. Our site footer states: "Estate agency licence No. kteb13: issued by the TRNC Ministry of the Interior under Law No. 38/2007." Our pre-contractual information states "Company registration No. kteb13. Office address: Özcan Çağaloğlu Plaza, A Block, Floor 2, Yenikent, North Cyprus", and that "Northea Property Development Ltd holds estate agency licence No. kteb13, issued by the TRNC Ministry of the Interior under Law No. 38/2007."

Exceptions and limits. An advisor does not replace your lawyer. Who pays the advisor (the buyer, the seller or both) should be set out in writing before any service is rendered.

Questions buyers ask

What is independent buyer representation in Northern Cyprus?

It is advice and negotiation by someone who works for the buyer under a written engagement and discloses who pays them. It sits alongside your own TRNC-licensed lawyer, who gives the legal advice. It does not replace the lawyer.

Is a buyer's advisor the same as a lawyer?

No. The advisor searches, screens, negotiates and coordinates. The lawyer checks title and eligibility, reviews the contract, registers it and applies for purchase permission. Keep the two roles separate and have both in writing.

Can my lawyer also act for the developer or seller?

Avoid it. A lawyer who acts for the seller or developer cannot press your interests against theirs. UK government guidance lists lawyers acting for both vendors or builders among the problems buyers in Cyprus have faced. Choose a lawyer who acts for you alone.

Who pays a buyer's advisor in Northern Cyprus?

It depends on the engagement. The fee may be paid by the buyer, the seller or both. What matters is that it is disclosed in writing before you rely on the advice. NORTHEA states this in its engagement letter.

Do I need a power of attorney?

Not always. The contract registration and the purchase-permission application can be made in person, through your lawyer or through an authorised attorney. If you grant a power of attorney, limit it in writing to the specific tasks and ask your lawyer to draft it.

Does NORTHEA also act for sellers?

Yes, through private seller mandates. If NORTHEA shows you a property, ask whether it acts for the seller; the answer and the fee arrangement are set out in writing in the engagement letter.
